Benjamin Schwartzman conducts a diverse complex litigation practice that includes extensive involvement in high-value corporate defense, federal and state class actions, government agency enforcements and multi-plaintiff recovery suits. He has won numerous successful trial verdicts, settlement awards and procedural dismissals for multinational business actors, particularly within the field of agronomic and agricultural disputes. In the realm of consumer fraud, securities fraud, and antitrust and civil rights, Benjamin has prosecuted and defended class action claims of national significance. He has also directed and achieved the full vindication of rights for corporate officers, directors and high net-worth investors through the pursuit and defense of inter- and intra-entity recovery efforts.
Because of his distinguished track record, Benjamin was named a member of the class action “dream team” by a prominent national legal advocacy group. He has also been called a “rising star” of litigation by state bar publications.
Successfully represented a collective group of related insurance entities and holding companies in litigation of claims against their institutional investment broker for securities fraud and violations of consumer protection statutes.
Performed co-lead counsel activities in a nationally reported suit that recovered hundreds of millions of dollars for merchant businesses forced to accept debit cards in violation of federal antitrust statutes.
In a multi-district litigation consolidated action, Benjamin served as co-lead counsel for a nationwide class of consumers who achieved settlement refunds of improperly collected early termination fees and service charges associated with VOIP telephone equipment.
Obtained a multi-million dollar settlement on behalf of a plaintiff class composed of individuals who had suffered wrongful reductions of their medical payment reimbursement entitlements under first-party provisions of their automobile insurance policies.
Successfully defended an institutional lending entity against claims brought by investors and a court-appointed receiver alleging bad faith, fraudulent transfer and misappropriation.
In a bankruptcy adversarial trial, Benjamin successfully defended timber magnate Timothy Blixseth and his corporate entities, from more than $230 million in breach of fiduciary duty claims brought by assorted corporate plaintiffs, including Credit Suisse, AG.
Obtained a directed verdict dismissal of federal Title VII employment claims brought against multinational mining subsidiary Nu-West Industries, Inc.
Successfully defeated multiple recovery claims asserted against an agricultural fertilizer retailer in the wake of a chemical release from its anhydrous ammonia distribution facility.
Pro Bono Cases
Defeated a residential management agency’s claims for imposition of housing fines and penalties against an immigrant refugee family from Iraq. At the same time, obtained a settlement award on behalf of his clients through assertion of counterclaims.
Successfully defended and settled claims of contract breach for the benefit of a non-profit international private school.
